1. Non-Refundable Enrollment Policy

All enrollments in MDS Academy programs are final and non-refundable.

 

Due to the digital nature of the course content, immediate access upon enrollment, and inclusion of proprietary educational materials and physical kits, no refunds, chargebacks, or cancellations will be issued once payment is processed.

 

2. Course Access & Program Availability

• Students receive access to the online course for 180 days from the date of enrollment.

• Access expires automatically at the end of the 180-day period unless otherwise stated in writing.

• MDS Academy reserves the right to update, modify, or enhance course content at any time without prior notice to maintain educational quality.

 

3. Mentorship & Support Terms

• One-on-one mentorship is provided after successful completion of the online course.

• Mentorship access lasts 90 days from the course completion date.

• Mentorship includes the ability to ask questions, submit practice work, and receive feedback via a designated chat platform.

• Mentorship does not include business guarantees, emergency consultations, or on-demand responses.

• Response times may vary based on volume and availability.

 

4. MDS Powder Brows Kit (Physical Product)

• MDS Kits are included with enrollment and shipped to the address provided at checkout.

• Kits ship within 3–5 business days after purchase, excluding weekends and holidays.

• MDS Academy is not responsible for delays caused by shipping carriers, incorrect addresses, or circumstances outside our control.

• Course access is not dependent on kit delivery.

 

5. Educational Purpose & No Business Guarantee

MDS Academy programs are educational in nature only.

• Enrollment does not guarantee income, certification acceptance, licensure, employment, or business success.

• Student results vary based on skill level, practice, experience, local regulations, and individual effort.

• MDS Academy does not provide legal, medical, or financial advice.

 

6. Licensing, Certification & Legal Compliance

• It is the Student’s responsibility to understand and comply with local, state, and country regulations related to permanent makeup and cosmetic services.

• MDS Academy is not responsible for licensing requirements, inspections, or regulatory approval in the Student’s jurisdiction.

 

7. Assumption of Risk & Liability Waiver

By enrolling, the Student acknowledges that:

• Permanent makeup and cosmetic services involve inherent risks

• MDS Academy is not liable for outcomes, injuries, allergic reactions, or client-related issues resulting from the Student’s application of techniques taught

• Students assume full responsibility for their professional services, tools, sanitation practices, and client care

 

8. Intellectual Property & Content Protection

All MDS Academy materials are intellectual property of Michelle Design Studio and MDS Academy, including but not limited to:

• Videos

• Training manuals

• MDS Text Book

• PDFs

• Slide decks

• Demonstrations

• Techniques and methods

 

Students may not:

• Share, copy, reproduce, sell, or distribute course content

• Record, screen capture, or repost training materials

• Teach or resell MDS Academy content as their own

 

Violation of this section may result in immediate termination of access without refund and potential legal action.

 

9. Community Guidelines & Conduct

Students enrolled in the Lifetime MDS Academy Student Community agree to:

• Maintain respectful and professional conduct

• Avoid harassment, misinformation, or unethical behavior

• Refrain from promoting competing programs or unauthorized content

 

MDS Academy reserves the right to remove any student from the community for violations without refund.

 

10. Termination of Access

MDS Academy reserves the right to:

• Suspend or terminate access to any program, mentorship, or community

• Do so without refund if Terms & Conditions are violated

 

11. Limitation of Liability

To the fullest extent permitted by law:

• MDS Academy and Michel Design Studio shall not be liable for direct, indirect, incidental, or consequential damages arising from course participation

• Liability is limited to the amount paid for enrollment

 

12. Right to Modify Terms

MDS Academy reserves the right to update or modify these Terms & Conditions at any time. Continued participation constitutes acceptance of the updated terms.

 

13. Governing Law

These Terms & Conditions shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.

 

14. Acknowledgment

By checking the box at checkout, the Student acknowledges that they:
